Obamacare Challenged by a Dozen Attorney Generals, but not California’s…

With the signing of Obamacare on Monday, March 22nd, many state Attorney Generals sprang into action to challenge the new law as unconstitutional. California State Attorney General Jerry Brown was not among them. Senator Tom Harmon (R-35th), along with the Senate Republican Caucus, is asking Jerry Brown to join with other states and dispute the constitutionality of HR 3950. Senate Republicans believe that the bill “imposes an unfunded mandate upon economically struggling states and illegally expands federal authority over state’s sovereign rights”. Senator Harmon, in a Caucus release stated, “Congress' action Sunday night blew through years of constitutional precedent and created a program that will unfairly burden states, citizens and small business. This is clearly a matter where the end does not justify the means.” AG Jerry Brown said he will “consider” legally challenging universal healthcare… but don’t hold your breath! Job Well Done?

In January the Legislature’s approval rating polled at 16 percent. This weekend that rating dropped to 13 percent, a low not seen since last October. The real kicker is that only 14 percent of Democrats think that the Democrat majority Legislature is doing a good job. More than 76 percent of all Californian’s disapprove of our Legislature’s performance. Maybe this is a good time for a break for our lawmakers. The Legislature is currently on spring recess and will be back in session April 5th.

Ballot Watch: November 2010

As of March 24th, the legalizing marijuana initiative qualified for the November 2010 ballot. The voters will decide whether to legalize and tax marijuana for those 21 and over. Medical marijuana use was approved by voters in 1996. This isn’t the first time California voters have been presented with this proposition. In 1972, Proposition 18, the first pot bill, was rejected by the voters. Your CFRW Advocate will watch closely as more initiatives are approved for the general election.

Although we are unable to give our members access to our web-based bill tracking service, there is a way you can find and monitor California legislation. You can access that information on the internet by going to the Legislature Home Page and completing the information on the right side by either indicating the bill number, the author, or key words. You can then subscribe to an email update and you will be notified when there is action on legislation of interest to you
